Abstract

Criminal liability in the case of C excavation mining along the Kampar River, in this case carried out by actors who do not have permission from the local government, because considering that the implementation of illegal mining activities does not have permission from the relevant agencies and it is rife in along the Kampar River. This activity is carried out by both individuals and legal entities, which carry out mining activities without fear, because it has become a daily routine for the local community to earn income for their household life. Based on the background above, the formulation of the problem that will be answered in writing this thesis includes: How is the enforcement of criminal law against rock quarry miners without permission and obstacles in enforcing criminal law against rock quarry miners without permission based on Law Number 3 of 2020 in Kampar Police jurisdiction. This research, when viewed from the type of research, this research is classified as Sociological legal research which is carried out by survey method, namely research directly to the research location. Meanwhile, if seen from its nature, this writing is descriptive-analytical, which means that the research is intended to provide a detailed, clear and systematic description of the main research problems. Enforcement of criminal law against perpetrators of rock excavation without a permit Based on Law Number 3 of 2020 in the Kampar Police jurisdiction that law enforcement is carried out pre-emptively, preventively and efforts to take action are only imposed on the perpetrators, but also as a form of shared responsibility for negligence and mistakes which was not only carried out by the perpetrators but also due to the lack of supervision carried out by the Kampar Regency Natural Resources (SDA) Office. Obstacles in enforcing criminal law against rock quarrying actors without permission Based on Law Number 3 of 2020 in the jurisdiction of the Kampar Police that the personnel factor, where the number of Kampar Police personnel is 21 people. Inadequate facilities and infrastructure factors. Community factors, people who work as mining workers certainly don't want to deal with the law so they are reluctant to provide information to the police. Cultural factors in which people are contaminated with luxurious lifestyles so that they work to be able to meet worldly needs. Economic factors, poor economic factors that cause people to work as rock quarrying workers without a permit in order to supplement their family needs.
