Abstract

Online gambling is categorized as a cyber crime because in carrying out its crimes, online gambling uses computers/cell phones and the internet as a medium to commit these gambling crimes. Gambling is basically against the norms of religion, decency and Pancasila morality, and can be dangerous for the survival of society, nation and state. Based on the background above, the formulation of the problem that will be answered in writing this thesis include: law enforcement against online gambling crime actors in the Kampar Police legal area and the inhibiting factors in law enforcement against online gambling crime in the Kampar Police legal area ? This research, when viewed from the type of research, can be grouped into sociological legal research or observational research, which is a data collection technique, in which the researcher makes direct observations of the object of research to see close up the activities carried out. Meanwhile, seen from its nature, it is descriptive analytical, namely the author tries to provide a complete, detailed and clear picture of a reality related to the enforcement of criminal law against online gambling crimes in the jurisdiction of the Kampar Police. From the results of research and discussion of law enforcement against perpetrators of online gambling crimes in the jurisdiction of the Kampar Police that online gambling investigations that have been carried out by Satreskrim Kampar investigators still use the instrument Article 303 of the Criminal Code instead of Article 27 paragraph (2) Jo. Article 45 Law Number 11 of 2008 in conjunction with Law Number 19 of 2016 Concerning Information and Electronic Transactions. Inhibiting factors in law enforcement against online gambling crimes in the Kampar Police jurisdiction include: Criminal sanctions against online gambling based on Article 45 of Law Number 11 of 2008 in conjunction with Law No. 19 of 2016 concerning Information and Electronic Transactions are lower than the threat of criminal sanctions in Article 303 of the Criminal Code, differences in detention time, lack of understanding and mastery of investigators in the field of information technology, is not balanced with the development of the ability of online gambling actors and the use of electronic evidence requires expert testimony, but Sat Investigators The Kampar Police Criminal Investigation Unit does not have a budget to pay for the expert's honorarium.
