Abstract

The cooperation agreement made between PT Wahanakarsa Swandiri and PT. Gajah Benu Ulak Bosa in terms of carrying out the oil pipeline work in the Rokan work area Segment 8 Balam Bangko has fulfilled the legal requirements of an agreement as stipulated in Article 1320 of the Civil Code. For the subjective terms of the agreement, namely: each party to the cooperation agreement agrees and is competent, both PT Wahanakarsa Swandiri and PT. Elephant Benu Ulak Bosa. The objective conditions in the agreement are clear, namely the implementation of oil pipeline work in the work area of Rokan Segment 8 Balam Bangko, while a legal cause, namely the contents and work of the oil pipeline in the work area of Rokan Segment 8 Balam Bangko. Based on the background above, the problem to be answered in this thesis research is about how the cooperation agreement between PT Wahanakarsa Swandiri and PT. Gajah Benu Ulak Bored in the Implementation of the Oil Pipeline Work in the Rokan Segment 8 Balam Bangko Work Area? And what are the legal consequences of the cooperation agreement between PT Wahanakarsa Swandiri and PT. Gajah Benu Ulak Bored in the Implementation of the Oil Pipeline Work in the Rokan Segment 8 Balam Bangko Work Area? This type of research is sociological legal research by means of a survey, namely studying the applicable legal provisions and what actually happens in society or in other words a research conducted on actual facts or real situations that occur in society with the intention of knowing and finding the facts and data needed collected then leading to problem identification which ultimately leads to solving the problem under study (finding the results of the research). Implementation of Cooperation Agreement between PT Wahanakarsa Swandiri and PT. Gajah Benu Ulak Bosa in terms of carrying out the work on the Oil Pipeline for Rokan Working Area Segment 8 Balam Bangko that the parties agreed to remind themselves of a special bond contained in a contractual agreement, and in the agreement PT. Wahanakarsa Swandiri as the first party in this agreement and PT. Gajah Benu Ulak Bosa as the second party in this agreement, but after this contract was running, it turned out that PT. Wahanakarsa Swandiri is only an intermediary company while PT. Pertagas and PT. PDC. This was known after there were obstacles in the implementation of work in the field that made PT. Gajah Benu Ulak Bosa stopped work several times because PT. Pertagas and PT. It turns out that PDC has not yet acquired 26 points of land, and has also not demolished community-owned houses and stalls due to compensation that has not been completed.
