Abstract
The Batak Toba indigenous people are a kinship system that adheres to apatrilineal system that draws lineages from the male/father side. In Batak society,only boys have the right to inheritance, while married girls will join their husband'sside. This causes the men’s degree will be more recognized than women's becausemen are the continuer of the next generation for the clan bearer of their father whilewomen are not the heirs. The problems in this study are related to the process of raising adoptedchildren in the Batak indigenous people in Aek Raja Tarutung Village, North Sumatra, as well as the position and rights of adopted children in the Batak indigenous people in Aek Raja Tarutung Village, North Sumatra. The type of author's research belongs to Observational Research or Survey research. Which author goes directly to the research site to get some data collection tools in the form of interviews and questionnaires. While the nature of the author'sresearch is descriptive. This means that this research can provide a clear and detailedimage of the rights of adopted children to inheritance according to the law tradition of the Batak Toba community in Aek Raja Tarutung Village, North Sumatra. The results of the research show that the process of adopting children in theBatak Toba indigenous community in its implementation does not have differences in its procedures since it is still carried out by following the rules that have been in effect for a long time. For the Batak Toba indigenous people, children are thecontinuer of their father's clan, therefore families who do not have sons can adoptchildren or manga to continue the clan line from the male side. The position and rights that must be done by adopted children are the same as biological children because adopted children after carrying out traditional processions are consideredlegal to be family members of parents who adopt children.
