Abstract

Trademarks, as one of the intellectual creations of humans closely related to economic and trade activities, play a crucial role. Micro, small, and medium enterprises (MSMEs) are national economic actors that have a significant role in economic development. The protection of intellectual property rights (IPRs) for MSMEs plays an important role in the era of globalization. Protection efforts can be made through the registration of eligible MSME products for IPRs. Based on the background above, the author formulates the main issues as follows: How are the legal protection efforts for trademarks in relation to MSME products in Pekanbaru? What are the challenges in implementing legal protection for trademarks in relation to MSME products in Pekanbaru? The research methodology used in this study is empirical legal research. The nature of this research is descriptive because the author intends to provide a clear and detailed description of the core research issues. Regarding data analysis, after the process of data collection and processing, the data are analyzed based on normative and empirical methods. After the data analysis, inductive conclusions are formulated, which means drawing conclusions from specific to general aspects. In conclusion, first, the legal protection efforts for trademarks in relation to MSME products in Pekanbaru occur when the trademarks of micro, small, and medium enterprises (MSMEs) have been registered with the Directorate General of Intellectual Property Rights (DGIPR) under the Ministry of Law and Human Rights. The challenges in protecting intellectual property rights in the field of trademarks for MSME products in Pekanbaru arise from the low understanding of MSME actors regarding trademark rights. They are mostly aware that trademark registration should be done in Jakarta, which requires significant costs and time. However, in terms of understanding the benefits and importance of trademark registration, most MSME actors have sufficient understanding. Additionally, there is a limited amount of education and awareness-raising activities conducted by relevant authorities, and the materials presented in these activities mainly focus on the benefits of intellectual property rights, especially trademarks.
