Abstract

The increasing divorce rate in Indonesia, including in the jurisdiction of the Religious Court of Pasir Pengaraian, has become a complex social issue that demands serious attention. Divorce not only affects the married couple but also has broader impacts on children, extended families, and social stability. Based on this phenomenon, this study aims to answer two main research questions: (1) What are the factors contributing to the high divorce rate in the Religious Court of Pasir Pengaraian? and (2) How is the government?s role implemented in addressing the high divorce rate in the area? This research employs a normative-empirical legal method with a qualitative descriptive approach. Data were collected through literature reviews and direct interviews with a judge of the Religious Court of Pasir Pengaraian, the Junior Legal Registrar, and representatives from BP4. The data were analyzed using statutory and empirical analysis through triangulation of sources. The findings reveal that the primary factors contributing to divorce include economic hardship, continuous disputes, abandonment, deviant behaviors such as alcohol abuse and gambling, and domestic violence. Although the government, through institutions such as BP4 and the Religious Court, has implemented mediation and counseling efforts, their effectiveness remains limited due to strong individual desires to divorce and the lack of awareness among couples to preserve their marriages. Therefore, a more comprehensive approach is needed, including strengthening pre-marital education and involving community and religious leaders in the mediation process.
