Abstract

The implementation of a loan and borrowing agreement in Perawang, Siak Regency between the Creditor and the Debtor has agreed to borrow money, so that the Creditor provides a loan in the form of money to the Debtor in the amount of Rp. 48,000,000, - (forty-eight million rupiah), but the Debtor only pays one installment of Rp. 1,500,000, - (one million five hundred rupiah) then the debtor no longer pays the installment until the agreed time. The main problems in this study are two, namely how the form of legal settlement against default in a loan and borrowing agreement (Case Study in Perawang, Siak Regency) and how the implementation of legal settlement against default in a loan and borrowing agreement (Case Study in Perawang, Siak Regency). This research uses sociology (empirical) legal research methods or observation (observational researsch) which is descriptive analysis by way of survey the location chosen to conduct this research is in Perawang Siak Regency, researchers conducted interviews with the Creditor and Debtor as my respondents. The results of the research conducted by the author can be concluded as follows: that the form of legal settlement against default by the debtor in the lending and borrowing agreement in the perawang area of the siak district is carried out by submitting a summons twice as well as holding mediation that brings together the creditor and the debtor. That the implementation of legal settlements against defaults by debtors in lending and borrowing agreements in the Perawang area of Siak Regency is that the summons given is only ignored and the mediation that is carried out does not go well so that the creditor files a simple lawsuit to the Siak District Court.
