Abstract

One form of crime that is often found in society is the crime of extortion with violence. In Indonesia, violations of criminal law are regulated in the Criminal Code (KUHP), which stipulates the punishment for the perpetrators. Extortion is an act that prioritizes personal interests by using violence or threats against other individuals to force them to surrender or achieve something. The main problem of this study is to find out how the trial process for perpetrators of extortion accompanied by violence and how the legal responsibility of the panel of judges is in imposing criminal sanctions for extortion cases accompanied by violence in Decision Number 586 / Pid-B / 2024 / PN.Pbr. This study uses a normative legal research approach method or research on law with a focus on literature studies, with a descriptive analytical research nature. The data used is secondary data that will be analyzed qualitatively. The results of the study that the author can conclude are that the trial process for extortion with violence takes place systematically, from the investigation to the judge's decision. The judge plays a role in ensuring justice, legal certainty, and benefits by considering legal, social, and impact aspects of the crime. The decision is not only a punishment,but also has educational value. Therefore, judges must act professionally and responsibly for the sake of substantive justice.
