Abstract

This research is motivated by the importance of understanding the legal status of land as stated in the Surat Keterangan Ganti Rugi (SKGR) in Serosah Village, Hulu Kuantan Subdistrict, Kuantan Singingi Regency. From 2022 to 2024, there were 20 (twenty) landowners whose land still held the status of SKGR. This is because the community in Serosah Village still does not understand the legal strength of SKGR as evidence of land ownership. Additionally, there are obstacles for the community in changing the land status to a Certificate of Ownership (SHM). The problem formulation in this research is how the binding force of the Surat Keterangan Ganti Rugi (SKGR) in Serosah Village, Hulu Kuantan Subdistrict, Kuantan Singingi Regency works, and what obstacles the community faces in upgrading the land status from SKGR to SHM in Serosah Village, Hulu Kuantan Subdistrict, Kuantan Singingi Regency. The research method used is empirical legal research with a literature analysis approach as supporting data. The data sources in this study include primary data obtained through interviews with designated informants and secondary data obtained from various literature and regulations. This research is descriptive and analytical in nature. This research found that the Surat Keterangan Ganti Rugi (SKGR) in Serosah Village functions as evidence of physical land possession and its status as a private deed with limited legal certainty, because the SKGR has not been registered with the National Land Agency (BPN) and does not have a Certificate of Ownership (SHM) as an authentic deed with legal certainty. Many residents still consider the SKGR to be sufficient proof of ownership. Additionally, there are several obstacles faced by the people of Serosah Village in converting the land status from SKGR to SHM, such as a lack of legal understanding regarding the functions of SKGR and SHM, administrative difficulties, high costs, and the distant location of the BPN office. Furthermore, the lack of socialization from the government regarding the procedures and benefits of obtaining the SHM also presents a significant challenge, leading many people to be unaware of the importance of this process and to believe that the SKGR is already a strong enough proof of ownership.
