Abstract

The customary law community of Kenegrian Kopah has strong rules regarding marriage, one of which is the prohibition of marrying within the same clan, which is believed to have significant social and cultural impacts. The history of this prohibition can be traced back to the traditions of the Minangkabau people, where the indigenous community at that time regulated many aspects of life, including marriage, to prevent division within society and ensure a clear line of descent. However, over time, this prohibition has faced challenges due to social, economic, and cultural changes influenced by modernization, migration, and globalization. The main issues discussed in this study are: the history of the prohibition of marrying within the same clan in the customary law community of Kenegrian Kopah in Kuantan Singingi Regency, and how the implementation of this prohibition has evolved within the community. Therefore, the purpose of this study is to explore the answers to these research questions. The research method used is a qualitative approach, through interviews and direct observation of village heads, customary leaders, and the community of Kenegrian Kopah, as well as literature review on the history and development of marriage prohibitions in the customary law community of Kenegrian Kopah, Kuantan Singingi Regency. The research findings show that the prohibition of marriage within the same clan is based on the belief that marrying within the same clan is akin to marrying one's own sibling, because the people of the Kenegrian Kopah community trace their lineage matrilineally (through the mother’s side) and practice a tradition of shared breastfeeding in the Koto house. Additionally, marriage within the same clan is believed to bring negative consequences, such as weak or defective offspring, or even disaster for the family. The indigenous community has also made efforts to adapt to the changes of time without losing their traditional roots, demonstrating a social dynamic that is able to maintain a balance between preserving cultural heritage and responding to the demands of modernization. An open dialogue is necessary between community leaders (ninik mamak) and the younger generation about the values of tradition, especially concerning the changes taking place in society.
