Abstract

The modus operandi of human smuggling is inseparable from the problem of demand and supply. The smugglers will facilitate those who can afford to pay, find intermediaries and then the captain of the ship and people who make fake documents if necessary. In law enforcement, the perpetrators of human smuggling crimes still need clear coordination and maximum authority corridors, especially for the Immigration PPNS because the Immigration PPNS is the first investigator who should know about human smuggling cases in Indonesia. Do not let the authority of PPNS be dominated by the Police or the Prosecutor's Office so that the Immigration PPNS seems powerless to carry out independent actions, the most important of which is Indonesia's cooperation with the international world which aims to accelerate the resolution of the problem of human smuggling in Indonesia. Based on the above background, the formulation of the problems that will be answered in writing this thesis includes: How to implement law enforcement against perpetrators of human smuggling abroad to work as Illegal TKI in the jurisdiction of the Tanjung Balai Asahan District Attorney's Office and what are the obstacles in the implementation of law enforcement against perpetrators of human smuggling abroad to work as Illegal TKI in the Tanjung District Attorney's Jurisdiction Asahan Hall. The writing of this thesis was carried out by the method of sociological legal research by way of survey, taking direct data with interviews as a data collection tool. The nature of this study is descriptive which means that this study provides a clear and detailed picture. Enforcement of Hukm Against Perpetrators of Human Smuggling Crimes in the Jurisdiction of the Tanjung Balai Asahan District Attorney's Office is carried out by the Tanjung Balai Asahan District Attorney's Office in collaboration with P4TKI in the Asahan area, the Tanjung Balai Asahan Police, the Tanjung Balai Asahan District Court and Correctional Institutions, but this criminal act still occurs, and it is carried out by Travel Agents or PPTKIS in sending CTKI/TKI abroad, especially Malaysia which is not accompanied by the existence of a Company License for the Placement of Indonesian Migrant Workers (SIP3PMI), but the sanctions received by the Travel Agent or PPTKIS agent are only in the form of administrative sanctions and plus the number of interested people who want to work abroad but are constrained by minimal procedures from the CTKI, and this is an opportunity for Travel Agents or PPTKIS to open opportunities for CTKI who want to work abroad but violate the rules that pretend.
