Abstract

The implementation of an oral house rental agreement between the landlord and the tenant raises a problem/conflict including late payment of rent and damaged house facilities. This agreement is only supported by agreement and presents one witness without a written document that clearly contains the rights and obligations of the parties. This problem is due to the community's lack of understanding of the importance of written agreements. The author formulates two main problems, namely how the implementation of an oral rental agreement between the owner of the rented house and the tenant in Tapung District, Kampar Regency, Karya Indah Village and efforts to resolve disputes that occur due to the oral rental agreement between the owner of the rented house and the tenant in Tapung District, Kampar Regency, Karya Indah Village. The type and nature of research in this writing is empirical sociological by conducting research directly into the field to find data and information. With the nature of analytical descriptive research. This research takes samples from the population using interviews as the main data collection tool. The results of the study concluded that the implementation of an oral house rental agreement in Tapung District, Kampar Regency, Karya Indah Village is carried out by means of the tenant contacting the owner of the house to be rented to meet directly to discuss the rental price and rental period, as well as other rules that are carried out orally, and this agreement is based on the principle of good faith. The implementation of this oral agreement only presents one witness. The implementation of this oral lease agreement is seen from two main aspects, namely, the aspect of the Landlord who reveals that the problems that often occur are late payment of rent and damaged facilities. Meanwhile, from the aspect of the tenant, namely the lack of maintenance of the house facilities by the landlord. The settlement of disputes that occur due to the implementation of an oral house rental agreement between the landlord and the tenant is by negotiation or deliberation directly between the conflicting parties.
