Abstract

Criminal law enforcement is the overall activity of law enforcement officers to maintain the balance of the rights and obligations of citizens in accordance with human dignity and responsibility as well as their respective responsibilities in accordance with their functions and for the sake of upholding law, justice and achieving legal certainty in accordance with the law. Theft with pembertan in the Kemuning Police Legal Area has experienced ups and downs over the last 3 (three) years but of the several cases of criminal acts of theft with pembertan reported by the public in 2021 there were 3 (three) cases but the police stated that 1 (one) case could be resolved, in 2022 the public again reported criminal acts of theft with 6 (six) cases being investigated but the police stated that 3 (three) cases had been resolved by the Kemuning police and in 2023 there will be 6 (six) cases of theft with crime received by the Kemuning police based on reports from the public who visited the Kemuning sector police office and as many as 2 (two) cases have been declared resolved by the Kemuning sector police. The formulation of the problem in this research is how to implement the law enforcement of criminal acts of theft with weighting in the Legal Area of the Kemuning Police and what are the inhibiting factors in enforcing the law for criminal acts of theft with weighting in the Legal Area of the Kemuning Police area. The type of research used is empirical legal research, which is a type of legal research that uses empirical data or data obtained through observation or measurement in real situations to answer a research question or test a hypothesis. The empirical data used can be quantitative data (numbers) or qualitative data (descriptions or images). The results of the research that the author can conclude are that the law enforcement efforts carried out by the Kemuning Sector Police have been carried out in accordance with the laws and regulations in force in Indonesia, however, in the process of law enforcement against theft with weighting, there are still obstacles that occur in the field, namely the distance from the location. between the police and the location where the incident occurred, which could result in the perpetrator fleeing before the police were at the scene, as well as a lack of community participation in arresting the perpetrator before the police arrived at the location where the incident occurred. For example, if a theft incident occurs at night in village 86 (Lapan Six) and the rainfall causes the road to get to the location to be very slippery and it takes quite a long time to get to the place of the incident.
