Abstract

In Indonesia, consumer protection is always related to trading activities carried out by business actors and consumers. Consumer protection is needed in trading activities because it involves the rights and obligations of business actors and consumers and creates prosperity for the community. The main problem in this study is how to protect consumers in the contract of buying and selling houses at PT Sinarmuda Setia Pertiwi and what are the legal efforts taken by consumers in implementing the contract of buying and selling houses at PT Sinarmuda Setia Pertiwi. While the Observational Research method uses a survey system, in which the author goes directly to the research location to obtain the necessary data using a data collection tool through questionnaire interviews and observation. The nature of this research is inductive which means the thought process starts from the beginning by looking at specific facts, and then draws new and general conclusions. The results of the discussion are consumer protection in the contract of buying and selling houses at PT Sinarmuda Setia Pertiwi that with the occurrence of defaults in the binding agreement for sale and purchase of land and buildings this can be seen from the forms of default that occur between developers or developers and buyers or consumers, including the working period, the agreed housing facilities and their protection have been regulated in the Consumer Protection Act. As for the efforts made by the buyer for the default action carried out by the developer in the contract of buying and selling houses at PT Sinarmuda Setia Pertiwi, it can be seen that from the responsibility of the developer or developer in the contract of sale and purchase of houses between the developer, the buyer has submitted a complaint to the developer and then the developer compensates for these losses, by repairing all the damage that is in the consumer's home.
