Abstract

Waste is a polemic issue that continues to occur, one of the factors causing it is because waste has not received special handling from the government, the lack of facilities and infrastructure for waste processing technology and the increasing amount of waste caused by many factors, but the most dominant is caused by humans themselves and many people out there who dispose of waste out of place. The main problem in researching the execution of unlawful acts in case number 262/Pdt.G/2021/Pn.Pbr is to find out the causes of execution and efforts made against the execution of garbage in the city of Pekanbaru. This research is descriptive analytical, meaning that the authors will provide a clear understanding or description of the matter of interest, but they will not consider or consider specifically the events and events. This research provides a process of non-execution that focuses on the execution of tort in case number 262/Pdt.G/Pn Pbr related to garbage problems in Pekanbaru City. Based on the results of research made by the author, it can be concluded that the unlawful act in case number 262/Pdt.G/2021/Pn Pbr in the city of Pekanbaru cannot be executed due to the defendant's non-compliance with the decision which requires the relevant parties to take certain actions. The defendant's non-compliance and the legal complexities involving a class action lawsuit are the main obstacles to the execution of the judgement in this case. The plaintiff continues to endeavour for the legal decision to be executed in accordance with the applicable provisions. The efforts made by the Environmental and Hygiene Service DLHK Pekanbaru City itself are to create an application system that can be utilised by the community called the BASADA application.
