Abstract

One area of activity that is directly related to the risk of realizing a good and healthy environment is a business entity that runs health services. The formulation of the problem in this research is how is the form of a health service business entity in Indonesia? and what about the civil liability of health service business entities in efforts to protect and manage the environment based on the principles of sustainable development? This research is legal research with a normative doctrinal approach, namely research conducted by examining literature or secondary data. Judging from its type, this research is classified into normative legal research (Library Research), namely research that originates from books or literature in the library. In this case, the form of a health service business entity in Indonesia and the civil liability of a health service business entity in efforts to protect and manage the environment based on the principles of sustainable development. The conclusion of this study is that health service business entities in Indonesia consist of several forms, namely hospitals and clinics with different forms of legal entities according to the legal needs of the founders. In hospital business entities, hospitals can be established by the Government, Regional Government, or the private sector. Hospitals managed by the private sector must be in the form of a company or foundation legal entity. The establishment of the hospital is a unilateral legal act of the foundation and this hospital is a business unit of the foundation. Therefore all policies in hospital management are in the organ of the foundation, so that between the foundation and the hospital is one management unit. Meanwhile, hospitals in the form of a Limited Liability Company (PT) were established by investors, which means that the hospital was independently established by the private sector. Civil liability for health service business entities in efforts to protect and manage the environment based on the principles of sustainable development includes the obligation of business entities to carry out their operational activities by taking into account their impact on the environment. In the context of environmental protection, health service enterprises must take steps aimed at preventing, reducing and managing negative impacts on the environment.
