Abstract
In carrying out the rental of shophouses, it is not permissible to violate the applicable agreement, likewise the rights and obligations must be fulfilled by both parties. If one party makes a mistake that causes the obligations that have been determined not to be fulfilled, then the party must be responsible by replacing the losses based on the default that they have made. The phenomenon that occurs in the field, most people even only make shophouse rental agreements based on verbally only. The many defaults on rentals have caused problems in the community. Likewise with the problem of renting shophouses (shophouses) in Lubuk Sakat Village, Perhentian Raja District, Kampar Regency, there are several cases of default in the rental between the tenant and the owner of the shophouse, the phenomenon in the village is when the tenant breaks his promise to pay his rent according to the agreement at the beginning. The main problem in this study is the default in the rental agreement for shophouses in Lubuk Sakat Village, Perhentian Raja District, Kampar Regency, and the obstacles in completing the rental agreement for shophouses in Lubuk Sakat Village, Perhentian Raja District, Kampar Regency. The type of research used, including in sociological legal research. Sociological legal research is research by looking at the legal reality in the community environment, looking at the legal aspects and social interactions in society that function as support for the needs of research or legal writing. While seen from its nature, this research is descriptive.. Default in the rental agreement for Ruko (Shop House) in Lubuk Sakat Village, Perhentian Raja District, Kampar Regency was caused by several factors, including factors from the shop house owner because he did not make a written rental agreement for the shop house, so that the tenant did not carry out the agreement in accordance with what had been mutually agreed upon and factors from the shop house tenant who was late in fulfilling the performance, and did not perform as expected. The obstacles in completing the rental agreement for Ruko (Shop House) in Lubuk Sakat Village, Perhentian Raja District, Kampar Regency include legal factors, where the lessee's lack of knowledge of the law on how the rental agreement should be made and the efforts that should be made if the tenant does not carry out the agreement as agreed upon, and caused by economic factors where the tenant's business is not running smoothly so that the tenant does not carry out the agreement in accordance with what has been mutually agreed upon
