Abstract
Go-Jek drivers, in carrying out Go-Food services to consumers, often get order cancellations by consumers even though drivers have paid sdirectly for the food costs to restaurants that have been chosen by previous consumers, this of course makes Go-Jek drivers suffer losses due to cancellations. food by consumers. Based on the background above, the problems to be answered in this thesis research are to find out Legal Protection for Online Drivers Against Cancellations of Food Orders by Consumers with Cash on Delivery Payments at PT. Go-Jek Indonesia in Pekanbaru City. To know the responsibility of PT. Go-Jek Indonesia for Canceling Food Orders by Consumers in Pekanbaru City? This type of research is sociological legal research which is carried out by means of a survey, namely research directly to the research location using a data collection tool in the form of interviews. Meanwhile, if seen from its nature, this writing is descriptive analytical, which means that the research is intended to provide a detailed, clear and systematic description. Legal Protection for Online Drivers Against Cancellation of Food Orders by Consumers with Cash on Delivery Payments at PT. Go-Jek Indonesia in Pekanbaru City is so far not clearly protected regarding which party can be responsible for the losses suffered by drivers. It is the right of drivers to get legal protection if they refer to Article 6 letter b UUPK. Legal protection is needed because a driver's rights and obligations are not fulfilled, namely the right to get appropriate payments from consumers, clearly this is not fulfilled Article 6 letter a UUPK. The losses experienced by drivers by consumers who do not have good intentions in ordering Go-Food services clearly violate the provisions of Article 1338 paragraph 3 of the Civil Code and are emphasized by Article 5 letter b UUPK. Based on the partnership agreement established between PT GoJek Indonesia and the driver, the two parties are based on a partnership relationship, one of the clauses of the agreement is that PT GoJek Indonesia has transferred responsibility if an error occurs caused by the driver. However, this problem is not caused by drivers but consumers who default. Responsibilities of PT. Go-Jek Indonesia for Canceling Food Orders by Consumers in Pekanbaru City that the driver's responsibility is only as a partner (carrier), PT GoJek's responsibility is only as a partner (liaison between drivers and consumers) and all actions taken by Consumers are considered to have followed the provisions made by PT GoJek Indonesia (consumers are free to act).
