Abstract
Facial whitening cosmetics are chemicals or other materials that function to fade black spots or melanin on facial skin. Currently, there are many cosmetics circulating that contain hazardous chemicals, these hazardous materials are mercury, hydroquinone, tretinoin and other hazardous chemicals. These materials are often misused as skin whitening or brightening agents. The use of facial whitening cosmetics that contain hazardous materials certainly results in losses for users. The losses experienced by consumers can be in the form of skin irritation, causing ochronosis (dark spots), skin cancer and can even cause death. The problem in this study is what is the form of compensation for the use of facial whitening cosmetics containing hazardous materials based on Law Number 8 of 1999. Are there any business actors who take compensation actions to consumers for the use of facial whitening cosmetics containing hazardous materials based on Law Number 8 of 1999. This study uses the Normative Juridical Research Method. This research is conducted by reviewing primary, secondary, and tertiary legal materials. This research is conducted by tracing laws and regulations, legal doctrines, and court decisions that are relevant to the problems studied, journals and previous research results. Based on the research obtained that the form of compensation for the use of facial whitening cosmetics containing hazardous materials based on Law Number 8 of 1999 seen from several aspects, namely based on Article 19 of the UUPK, business actors are required to provide compensation to consumers in the form of a refund, replacement of goods or services with equivalent ones, or maintenance or repair of goods. Business actors who carry out compensation actions for consumers are obliged to provide compensation to consumers directly for material and immaterial losses experienced, however, there are still many business actors who do not provide compensation for various reasons.
