Abstract

National development wants to create a society that is just, prosperous and evenly distributed both materially and spiritually, then based on Article 18 paragraph (6) of the 1945 Constitution the regional government has special and special authorities who are entitled, authorized and obliged to regulate and manage their own households. The Regional People's Legislative Council of Kuansing Regency as a public organization as the organizer of regional autonomy has a legislative function that acts as an idea generator without forming regional regulations together with the regional head. The Kuantan Singingi Regency People's Representative Council did not use its initiative rights optimally. It can be seen that from 2019 to 2022 only one initiative right was proposed by members of the Kuantan Singingi Regency DPRD. However, the right of initiative was also not Discussed. This study aims to find out about the implementation of the legislative function and the implementation of initiative rights in the Kuantan Singingi Regency DPRD. This type of research is empirical research. The research method used in this study is included in observational research, namely research using an empirical approach to positive law using interview data collection tools. The results of this study are that the legislative function of the Kuantan Singingi Regency DPRD is not running optimally because the members of the council in carrying out the planning stages, the drafting stage, the discussion stage, the determination stage and the promulgation stage do not go well, it can be seen that the Kuantan Singingi Regency DPRD only Proposed 1 Raperda from Initiative Rights in 2020 But it also didn't materialize into a regional regulation, it was only a proposal. The factors causing the non-realization of the initiative rights of the Kuantan Singingi Regency DPRD are first, the factor of the lack of quality human resources/education that lacks creativity in drafting regional regulations. second, political/communication factors also influence which DPRD members should sit for the interests of the people instead for the interests of political parties. third, the APDB factor that does not meet the budget is the most common thing that occurs in various regions, fourth, the factor of the lack of experts, expert teams and supporting data and fifth, disharmony between the executive and legislation is the last factor that makes it not realized.
