Abstract

A debit card is a card that can be used for shopping other than using cash from a bank account, each transaction will be subject to a discount, the advantage gained in using this card is that there is no need to carry cash so it is safer, and with this card the public can easily make transactions remotely via transfer, but every month the user of this card will be subject to a discount, this card has a limit, if the limit is less then this card cannot be used for transactions. Because of this, there are many problems and complaints that arise and are felt by customers as debit card users here, therefore the author is compelled to examine more deeply how the actual legal protection must be given to debit card users.The main issues in this study are: How is the Implementation of Legal Protection for Customers as Debit Card Holders in terms of Law Number 8 of 1999 concerning Consumer Protection at BRI Bank Sibiruang Unit and What are the Obstacles Found in the Implementation of Legal Protection for Customers as Holders Bank BRI Debit Card in View of Law Number 8 of 1999 Concerning Consumer Protection at Bank BRI Unit Sibiruang.The research method used in this research is: observational research by means of surveys, namely research conducted at research locations using data collection tools. And this research is analytical descriptive in nature, which means that the research is intended to provide a detailed, clear and systematic description of the main research issues.From the results of the research and discussion that the authors conducted in the field, legal protection for customers as debit card holders at Bank BRI sibiruang unit based on Law Number 8 of 1999 concerning Consumer Protection was not implemented, firstly seen from the consumer side, consumers as customers do not get protection for losses experienced, there is no initial information provided by the Bank to customers regarding monthly deductions and deductions when making transactions that will be issued by customers when using their debit cards so large and clear this is not in accordance with UUPK rules article 4 letter c, then seen from the business actors, the Bank said that they had provided clear information to their customers about the debit card while in the field the customer answered that the Bank did not explain and provide clear information about the conditions for using the card. While the obstacles found in the implementation of legal protection for customers as debit card holders in terms of Law No. 8 of 1999 concerning Consumer Protection are seen from the business actor, where the Bank does not want to compensate for losses from customers, seen from the customer side as a consumer where the customer pay less attention to information and be less careful in using this card.
