Abstract

The COD (Cash on Delivery) payment method or on-site payment system, nowadays causes problems in buying and selling transactions. Where in this case the aggrieved party is a business actor. Some online sellers/business actors on Shopee Loka Pasar complained about unilateral order cancellations. Where when the goods have arrived at the destination address but the consumer is not in place, so that the goods are returned to the business actor, if for two days the consumer is not clear, the goods are returned to the seller. The thesis entitled "Legal Protection for Sellers Against Refusal of Payment by Buyers in Online Buying and Selling on Shopee Marketplace (Study in Harapan Raya Pekanbaru City)" discusses the following problems: What is the form of Protection for Sellers Against Refusal of Payment by Buyers in Online Buying and Selling on Shopee Marketplace (Study in Harapan Raya Pekanbaru City) and What are the obstacles in Legal Protection for Sellers Against Refusal of Payment by Buyers in Online Buying and Selling in Shopee Marketplace (Study in Harapan Raya, Pekanbaru City). The method used to answer the problems mentioned above is by using the empirical legal research method, which is a data collection technique, where the researcher makes direct observations to the research object to see the activities carried out closely. Data collection method is carried out by interviews, questionnaires and observations. The results of the study show that the form of legal protection for business actors for the cancellation of payments by buyers in the law is contained in the Civil Code, UUPK, and ITE Law Article 5 paragraph (1) of Law Number 1 of 2024. The UUPK provides protection in the form of the rights of business actors. Then the ITE Law provides protection where business actors can sue consumers by making electronic information and/or electronic documents as valid legal evidence in the form of screenshots or proof of sales transactions with consumers until they commit a default. The Shopee application itself provides legal protection for business actors by deactivating the Shopee account of Shoppers who cancel COD payments on the second COD payment cancellation within 60 days. The factors that become obstacles in the legal protection of the seller are due to things outside the agreement, such as the buyer's unstable economic condition, the buyer who cuts off communication with the seller (blocking the seller),and hit and run.
