Abstract
Illegal cell phone trade or Black Market in the jurisdiction of the Bengkalis Regency Customs and Excise Office has become a legal problem that violates the enforcement of Law Number 17 of 2006 concerning Customs and Consumer Protection Law No. 8 of 1999 and the Criminal Code have not yet found a way out, so there is still a need for stricter and more efficient law enforcement in relation to the rampant crime of trading in cellular phones/Black Market cellular phones. Based on the background above, the problems to be answered in this thesis research are whether the factors causing the crime of cell phone smuggling in the jurisdiction of the Customs and Excise Office of Bengkalis Regency, what is the modus operandi of cell phone smuggling and how to deal with the crime of cell phone smuggling in the jurisdiction Bengkalis Regency Customs and Excise Office. This type of research is sociological legal research which is carried out by means of a survey, namely research directly to the research location using a data collection tool in the form of interviews. Meanwhile, if seen from its nature, this writing is descriptive analytical, which means that the research is intended to provide a detailed, clear and systematic description. Factors Causing the Crime of Cellular Phone Smuggling in the Legal Area of the Customs and Excise Office of Bengkalis Regency include geographical factors, domestic industrial conditions, economic factors, human resources, mentality and factors, the modus operandi of the crime of cell phone smuggling in the jurisdiction Bengkalis Regency Customs and Excise Office that the perpetrator brought goods in the form of smuggled cellphones from Batam, which were sent by Gino (DPO) and Gino was also Abeng's messenger who is domiciled in Batam, indeed before the suspect picked up the goods Abeng and Gino had contact the perpetrator beforehand to inform him that the goods will arrive at Bengkalis, and the perpetrator will pick them up at the port using the MV passenger ship. Dumai Express, and of the 10 shipments of smuggled goods that have been carried out by the perpetrators, they have always used the Dumai Express Passenger Ship. Countermeasures against the crime of cell phone smuggling in the jurisdiction of the Customs and Excise Office of Bengkalis Regency are carried out by way of a penal policy which can be interpreted as an effort to deal with crime through criminal means and efforts to deal with crime through non-penal channels focus more on the nature of "preventive" (prevention/deterrence/ control) before the crime occurs.
