Abstract
Based on the provisions of Article 4 of Law Number 8 of 1999 concerning Consumer Protection, it states that consumers have rights. One of the consumer rights is stated in article 4 letter a, namely the right to comfort, security and safety in consuming goods and/or services. Apart from that, the prohibition on the use of formaldehyde in food products is also regulated in Law Number 18 of 2012 concerning Food, namely regarding criminal sanctions contained in Article 133 - Article 148, apart from that in the provisions of Articles 60, 61, 64, 65 and Article 67 of the Law. Number 18 of 2012 concerning Food regulates administrative sanctions in the form of closure or revocation of business permits. In fact, consumer rights are often ignored by business actors in producing goods and/or services. It is still found that business actors who produce goods and/or services do not pay attention to consumer rights. The main problem of this research is how consumer protection is for food business actors who use formalin in the lower market of Pekanbaru city and what are the obstacles to consumer protection for food business actors who use formalin in the lower market of Pekanbaru city. The purpose of writing this thesis is: First, to find out consumer protection for food business actors who use formalin in the lower market of Pekanbaru City. Second, knowing the obstacles to consumer protection for food businesses that use formalin in the lower market of Pekanbaru City. This type of research is included in empirical sociological legal research. This research uses secondary data as the main material. As a form of compensation to consumers in accordance with the provisions of Law Number 8 of 1999 article 19 paragraph (1) which stipulates that business actors are responsible for providing compensation for damage, pollution and/or losses experienced by consumers. In reality, what consumers experience in the field is not in accordance with the applicable provisions in Law Number 8 of 1999 article 19 paragraph (1) concerning consumer protection. Barriers to obtaining consumer protection include a lack of consumer knowledge about the UUPK, minimal consumer understanding of the food products they buy, weak government supervision, and the need for the government to provide legal education regarding the dangers of consuming formaldehyde and the characteristics of foods that contain formaldehyde.
