Abstract

The modus operandi of human smuggling is inseparable from the problem of demand and supply (payment). The smugglers will facilitate those who are able to pay, then find an intermediary and then the captain of the ship and the person who will make false documents if needed. In law enforcement against perpetrators of human smuggling crimes, clear coordination and maximum authority corridors are needed, especially for the Immigration PPNS because the Immigration PPNS is the first investigator who should know about human smuggling cases in Indonesia. Do not let the authority of the PPNS be dominated by the Police so that the Immigration PPNS seems helpless to take independent actions and most importantly the cooperation between Indonesia and the international world which aims to accelerate the resolution of human smuggling problems in Indonesia. Based on the above background, the problem formulations that will be answered in writing this thesis include: How is Law Enforcement Against Perpetrators of Criminal Acts of HumanSmuggling (People Smuggling) in the Dumai Police Legal Area and How are the Obstacles and Constraints of the Dumai Police in Law Enforcement Against Perpetrators of Criminal Acts of HumanSmuggling (People Smuggling) in the Dumai Police Legal Area. Writing this thesis, using sociological legal research methods by means of surveys, namely research that takes data directly from respondents by using interviews as a data collection tool, then the data taken is processed so that conclusions are obtained in a deductive way. Meanwhile, when viewed from its nature, this research is descriptive, namely research that explains in the form of clear and detailed sentences about the two problem formulations discussed. Law Enforcement Against Perpetrators of Criminal Acts of HumanSmuggling (People Smuggling) in the Dumai Police Law Area is carried out by the Dumai Police in collaboration with the P4TKI of the Dumai region, the Dumai District Attorney's Office, the Dumai District Court and the Correctional Institution, but this criminal act still occurs, and it is carried out by unscrupulous Travel Agents or PPTKIS in sending CTKI / TKI abroad, especially Malaysia, which is not accompanied by a Permit for Placement of Indonesian Migrant Workers (SIP3MI), However, the sanctions received by the Travel Agent or PPTKIS are only in the form of administrative sanctions only and coupled with the large number of enthusiasts from prospective Indonesian workers who want to work to Malaysia but are constrained due to the minimal procedures of the CTKI, and this is an opportunity for unscrupulous Travel Agents or PPTKIS to open opportunities for CTKI who want to work abroad but violate applicable regulations.
