Abstract

Marriage is the most important act in life, because it is a form of human interaction in social life and its environment. The smallest social community, but more than that, marriage is a legal and religious act. The high divorce rate in Pekanbaru City should be a concern and responsibility for all parties. The Pekanbaru City Religious Court has received, examined and decided every case submitted to the Pekanbaru City Religious Court, especially in divorce cases, which is the highest number of cases, namely 1,586 cases in 2022 and continues to increase. The problems raised in this research are what are the causes of divorce in Tenayan Raya District, in the Legal Area of the Pekanbaru City Religious Court and how are divorce cases resolved in Senapelan District, in the legal area of the Pekanbaru City Religious Court. The research method used is an empirical method. And the nature of this research is an analytical description using data collection tools in the form of Questionnaires and Interviews which are concerned with the causes of divorce and the resolution of divorce cases. The results of the research show that the dominant factors that cause the high divorce rate, especially in divorce cases, are: First, there were 9 respondents (42.9%) who answered because of disputes. Second, 4 respondents (19%) answered because of Domestic Violence (KDRT) and then 8 respondents (38.1%) answered other reasons. Usually the causal factors are adultery, drunkenness, gambling, leaving one of the parties, being sentenced to prison, polygamy and economics. The level of success of mediation in divorce cases, especially Divorce in the Pekanbaru City Religious Court, if seen from the implementation of mediation, has been effective in accordance with PERMA Number 1 of 2016. However, the results of successful mediation carried out by mediator judges have not yet shown maximum results, especially in cases Divorce.
