Abstract

Alternative Dispute Resolution or also commonly called ADR is a procedure in resolving conflicts outside the court. Initially, ADR was seen as another solution to resolving cases related to disputes. However, when implemented in Siak Hulu District, there are still several obstacles experienced both by the Traffic Officer and from the parties involved in a traffic accident in Siak Hulu District. The occurrence of a traffic accident in the Jurisdiction of Siak Hulu District which involved two-wheeled motorized vehicles and four-wheeled and six-wheeled motorized vehicles, which harmed the victim. The ADR used in the settlement of this case is Mediation, which is often used to obtain justice in a restorative manner. This study discusses how the application of ADR as an alternative to solving traffic crimes in the jurisdiction of the Siak Hulu Police and what are the weaknesses in the application of Alternative Dispute Resolution (ADR) in resolving traffic crime cases in the jurisdiction of the Siak Hulu Police. This study uses the Sociological Legal Research Method of legal research that provides analysis and conducts studies on how the law works among citizens. In this case, the researcher provides analysis and conducts a study on legal work in the field of Traffic and Road Transportation in Siak Hulu District and also how to apply rules related to ADR and also Restorative Justice efforts. The result of this research is the application of Alternative Dispute Resolution (ADR) as an alternative to the settlement of traffic crimes in the jurisdiction of the Siak Hulu Police depending on the type of traffic crime and also looking at how much losses are experienced by the community in the jurisdiction of Siak Hulu District in order to get restorative justice. And the weakness in the application of Alternative Dispute Resolution (ADR) in the settlement of traffic crime cases in the jurisdiction of the Siak Hulu Police is that the public still does not know the ADR in the settlement of the Laka Lantas case on the basis of large losses between the perpetrator and the victim, and also because of the position that is considered weak for each party.
