Abstract
In recent years, electronic cigarettes have rapidly developed in Indonesia alongside the growing number of vape shops. Today, electronic cigarettes are no longer just an alternative for conventional smokers but have become part of the lifestyle, especially among young people. However, in the distribution of E-Liquid in electronic cigarettes, the government needs to conduct laboratory tests to examine the substances contained in them, as they may pose health risks. Therefore, regulations are needed to protect the public in the buying and selling process of electronic cigarettes, ensuring that consumer rights are fulfilled and the negative impacts of electronic cigarette use are avoided. The lack of information provided by business operators and the absence of clear information in the purchase of electronic cigarettes often leaves consumers confused. As a result, many consumers of electronic cigarettes at CV. Fly Vapor in Pekanbaru experience product damage. The research questions in this study are, first, what is the form of legal protection for consumers of electronic cigarettes who suffer losses at CV. Fly Vapor in Pekanbaru, and second, what is the liability of business operators for the losses suffered by electronic cigarette consumers at CV. Fly Vapor in Pekanbaru. This research uses an empirical legal study approach, analyzing directly by going into the field to obtain information through respondents in the field with interviews and documentation. The results of this study indicate that legal protection for consumers of electronic cigarettes at CV. Fly Vapor in Pekanbaru has not been fully met. This issue is due to the lack of clear legal regulations regarding the content of E-Liquid in electronic cigarettes and the unclear authority between government regulations and BPOM in supervising these products. Additionally, business operators are still reluctant to take responsibility for the losses suffered by consumers, even though under Article 19 of the Consumer Protection Law (UUPK), they should provide compensation or reimbursement for these losses. Business operators argue that the damage experienced by electronic cigarette consumers is due to human error. However, the facts found in the field show that business operators do not provide adequate information about product guarantees and only provide very limited usage instructions.
