Abstract

This research was conducted using juridical research methods and literature studies about the Online Arisan Phenomenon in Indonesia. Online Arisan is a social gathering activity carried out online or via social media carried out by several parties using the cash circulation method. Fraud cases using the Online Arisan mode are often carried out on various social media such as WhatsApp, Facebook and Instagram. However, apart from the positive impacts, there are also negative impacts through this development. This research explains how legal protection is for victims who experience losses due to online-based social gatherings in terms of Article 1243 of the Civil Code and how to enforce the law against unlicensed online social gathering owners. In April 2023, the social gathering case in Pekanbaru started when the owner spread information about the social gathering via social media. However, after the agreed due date, the owner of the social gathering ran away. A form of legal protection for online social gathering participants is paying compensation as regulated in Article 1243 of the Civil Code in addition to compensation. Forms of law enforcement for online social gathering owners can be charged under Article 372 in conjunction with Article 378 of the Criminal Code and/or Law of the Republic of Indonesia Number 8 of 2010.
