Abstract

It is very necessary to protect consumers in e-commerce transactions so that every consumer has legal certainty in conducting e-commerce transactions, especially in buying and selling used clothing online. The rise of cases of goods that do not match the pictures that occur in the marketplace shows the weak position of consumers in online buying and selling, even though this does not mean that sellers are free to sell their goods without complying with applicable regulations. Article 4 Letter c of the Consumer Protection Law explains that consumers have the right to correct, clear, and honest information about the conditions and guarantees of goods and / or services. ?The following topics will be covered in this study: a. how consumers who purchase used clothing online through Instagram may be protected legally from losses caused by hidden defects; b. how social media platforms and the government oversee and control online sales and purchases, particularly when it comes to protecting consumers from hidden defects. ?This type of research falls into the category of empirical juridical or field research, which focuses on analyzing the applicable legal regulations and how they are implemented in people's lives. This method allows researchers to understand more deeply how the law is applied in practice in society. ?The results show that consumer protection in online buying and selling transactions in Indonesia is still not optimal, especially in overcoming the problem of hidden defects in used products. Although Law No. 8/1999 on Consumer Protection has regulated consumer rights, its implementation in the context of online sales still faces various challenges, especially in terms of proof and compensation mechanisms. A case study on the Instagram account @Boss.Kusut reveals that consumers often have difficulty obtaining compensation or refunds when the products received are not as promised.
