Abstract

Legal protection for workers is intended to guarantee the basic rights of workers and guarantee equality of opportunity and treatment without discrimination on any basis in order to realize the welfare of workers and their families while still paying attention to developments in the business world. Therefore, entrepreneurs have an important role in ensuring the welfare of their workforce. Employers have an obligation to provide this protection which can be in the form of social security for workers which includes: Old Age Security, Accident Insurance, Death Insurance and Health Care Guarantee. However, not all companies carry out their obligations based on existing provisions, many companies, especially small PTs and CVs, do not register their workers' social security with BPJS Employment. In this research, the problem formulation is how to provide legal protection for coffee shop workers who are not registered with BPJS Employment and how to apply sanctions to coffee shop owners who do not register their workers in the BPJS Employment program. The research method used is empirical legal research with a descriptive approach and uses data sources, namely primary data and secondary data. Therefore, the author uses the census and interview method, which is the method used when it is small, so that the author uses this population as a whole as respondents. Based on the research results, it is understood that legal protection for BPJS Employment membership registration by employers is mandatory and regulated in Article 14 and Article 15 of Law Number 4 of 2011 concerning BPJS. Meanwhile, if employers do not register their workers with BPJS Employment, they may be subject to administrative sanctions as regulated in Article 9 of the BPJS Law which includes: written administrative sanctions, fines and restrictions on certain public services. Furthermore, the factors inhibiting the implementation of laws for employment, especially in providing legal protection for workers' social security, are influenced by several factors, namely: legal supervision factors, employers' indifference factors and workers' low knowledge of their rights.
