Abstract
Default is the implementation of an agreement that is not on time or done improperly or not implemented at all. In general, default is a situation where a debtor is at a stage prior to the agreement, the formation of the agreement and its implementation. Basically, it often happens in the sale and purchase agreement of a used car that can lead to acts of default. Such as, the existence of hidden damage that is not known by consumers as buyers of used cars, resulting in losses for those who buy used cars. The sale and purchase agreement contains the agreement and warranty of used cars purchased by consumers. It turns out that the fact is that the seller does not want to replace for reasons of overpriced costs. As for the formulation of the problem in this thesis research are: first, What are the factors of default against the provision of warranty buying and selling used cars in the city of pekanbaru?, second, How is the legal protection against the provision of warranty sale and purchase of used cars in the city of pekanbaru ? The research method used in this study is a type of empirical legal research, namely research conducted directly to the research site by using data collection tools in the form of interviews and observations of respondents and research objects. While the nature of this research is analytical destructive is a method used to determine the picture, the situation, a thing by describing it in as much detail as possible based on existing facts. The method of drawing conclusions that the author uses is the deductive method, which is the process of drawing conclusions from things that are general to things that are special. From the results of research and discussion, the researchers found that, first, there are hidden defects that are not explained by the seller. This is because the buyer is also less critical in checking the object, namely the used car, so that problems arise. secondly, hidden defects lead to consequences that must be borne by the defaulting party. The seller has the obligation to bear hidden defects in the used car.
