Abstract

Savings and loan agreements between cooperatives and farmers are an important instrument in supporting economic activities in rural areas. Cooperatives that focus on improving the welfare of village communities are called village unit cooperatives (KUD) which generally help improve shop businesses, service businesses, savings and loan businesses, electricity businesses, agricultural businesses, livestock businesses and so on in a village by providing loans for goods. or money. One of them is carried out by the Kijang Mas Lestari Producer Village Unit Cooperative in Tebing Lestari Village, Tapung Hilir District, Kampar Regency. However, in its implementation, violations of payment obligations by farmers often occur, giving rise to legal and financial problems for cooperatives so that it requires handling of acts of default which are detrimental to the Kijang Mas Lestari Producer Village Unit Cooperative. The main problem in this research is what are the obstacles in the accountability of farmers who do not pay loans based on savings and loan agreements, a case study of the Kijang Mas Lestari Producer Village Unit Cooperative in Tebing Lestari Village, Tapung Hilir District, Kampar Regency and how to resolve disputes against farmers who do not pay loans according to the agreement Savings and Loans Case Study of the Kijang Mas Lestari Producer Village Unit Cooperative in Tebing Lestari Village, Tapung Hilir District, Kampar Regency. The research carried out is an empirical legal research method using research or field observations by surveying directly into the field, to collect primary data and secondary data obtained from respondents either through questionnaires or interviews to be used as data or information as material for writing this research. Based on the research results, it can be understood that the obstacle to responsibility for farmers who do not pay loans for savings and loan agreements to the Kijang Mas Lestari Producer Village Unit Cooperative in Tebing Lestari Village, Tapung Hilir District, Kampar Regency is that the production costs (capital) that farmers must pay are higher than the palm oil harvest results in difficulties for farmers in paying their monthly loan installments to the Cooperative, apart from that, plant health problems which are vulnerable to pest attacks mean that production results are not optimal, thereby reducing farmers' income, and natural factors such as drought cannot be prevented by farmers, making the harvest not good. The dispute resolution chosen by the Kijang Mas Lestari Producer Village Unit Cooperative in Tebing Lestari Village when the debtors did not pay back their loans, namely resolving it by means of deliberation and kinship together between the Farmers as borrowers, the Farmer Group, the Cooperative Supervisory Board, and the Cooperative Management created obstacles because Convoluted dispute resolution and unclear dispute resolution make farmers reluctant to pay loans as best they can.
