Abstract

In implementing an agreement, it is possible that a breach of contract will arise by one of the parties. In such circumstances, the provisions that must be fulfilled arising from the default apply, namely the possibility of termination of the agreement, compensation for losses or fulfillment. Service users certainly want the implementing contractor to be responsible for carrying out their obligations in accordance with what is contained in the contract, and vice versa. The main problem in this research is how there is default on the implementation of the construction work agreement between CV. Duta Amanah with the Pelalawan District Health Service based on Presidential Regulation Number 12 of 2021 concerning Government Procurement of Goods/Services, and what are the obstacles in implementing the construction work agreement between CV. Trust Ambassador with the Pelalawan District Health Service based on Presidential Regulation Number 12 of 2021 concerning Procurement of Government Goods/Services The type of research used includes sociological legal research. Sociological legal research is research that looks at the legal reality in society, looking at legal aspects and social interactions in society which function as support for the needs of legal research or writing. Meanwhile, judging from its nature, this research is descriptive in nature. Implementation of the construction work agreement between CV. Duta Amanah with the Pelalawan District Health Service based on Presidential Regulation Number 12 of 2021 concerning Government Procurement of Goods/Services has not gone well, where there has been a default on the construction work agreement between CV. Duta Amanah with the Pelalawan District Health Service because the Pelalawan District Government has not made payment for the work due to the 2023 budget deficit. Obstacles in implementing the construction work agreement between CV. Duta Amanah with the Pelalawan Regency Health Service, namely that there is a budget deficit for the Pelalawan Regency Regional Government in 2023 so that they have not been able to make payments for this work. Efforts to resolve between CV. Duta Amanah with the Pelalawan District Health Service regarding this work, namely that the Regional Government of Pelalawan Regency will budget the remaining payment for the work in the 2024 APBD-P.
