Abstract

In the Government Regulation of the Republic of Indonesia Number 109 of 2012 concerning Safeguarding of Materials Containing Addictive Substances in the Form of Tobacco Products for Health (hereinafter referred to as PP Number 109 of 2012) in Article 1 number 3 provides a definition of cigarettes, namely "Cigarettes are one of the tobacco products intended for burning and smoking and/or inhaling the smoke, including clove cigarettes, white cigarettes, cigars or other forms produced from the plants Nicotiana tabacum, Nicotiana rustica, and other species or synthetic ones whose smoke contains nicotine and tar, with or without additional ingredients. The main problems in this research are 1. What is the legal review of traders who sell cigarettes to minors (case study of daily goods shops on Jalan Kaharudin Nasution, Pekanbaru City). What are the Obstacles to Traders Still Selling Cigarettes to Underage Children (Case Study of Daily Goods Shop on Jalan Kaharudin Nasution, Pekanbaru City). This research uses the legal research method of sosiological or observational research where this research collects information from respondents using data collection tools in the form of interviews and the nature of this research is analytical descriptive, that is, the research provides data as accurately as possible to describe the Legal Review of Traders Who Sell Cigarettes to Under Children. Age Case Study of Daily Goods Shop on Jalan Kaharudin Nasution, Pekanbaru City, The method for drawing conclusions is deductive from general things to specific things. The research results show that the implementation of the policy of prohibiting trading in cigarette products to children in Bekasi City has several supporting and inhibiting factors in its implementation. Supporting factors include the existence of Pekanbaru City Regional Regulation Number 15 of 2019 concerning KTR in Non-Smoking Areas, although it has not been implemented effectively due to Covid-19 constraints, the Health Service which has a special Clean and Healthy Living Behavior (PHBS) program, Satpol PP which has carried out socialization Based on the Non-Smoking Area (KTR) regulations, Business Actors who agree that legal protection is needed for minors, and there are minors who have smoking behavior and have the desire to stop. The obstacles to traders still selling cigarettes to minors (case study of daily goods shops on Jalan Kaharudin Nasution, Pekanbaru City) are lack of good faith, lack of legal knowledge and legal awareness from business actors, lack of consumer education for underage consumers.
