Abstract

The existence of outsourcing companies that violate the Employment Law, these companies can come from the side of companies that use outsourcing services or companies that organize outsourcing, where the service provider company makes an agreement but the rights of outsourcing workers or laborers are not fulfilled. The formulation of the problem in this study is: What is the form of Implementation of the Employment Agreement between Outsourcing Workers and PT Rama Indonesia Pekanbaru Based on Law Number 13 of 2003 Concerning Manpower in conjunction with the Job Creation Law No. 6 of 2023 and What are the obstacles that arise in the Implementation of the Employment Agreement between Outsourcing Workers and PT Rama Indonesia Pekanbaru Based on Law Number 13 of 2003 Concerning Manpower in conjunction with the Job Creation Law No. 6 of 2023. The type of legal research method that the researcher uses in this thesis research is the Type of Sociological Legal Research, namely research that is directly carried out at the research location with the nature of this research being descriptive analysis, which aims to systematically describe and explain a phenomenon that exists in the field. The results of the research that the author found were that PT. Rama Indonesia is a company engaged in the Outsourcing sector which has the Implementation of a certain period of work agreement carried out in written form PT. Rama Indonesia has indeed fulfilled some of its workers' rights, but the important aspects are that the Right to Job Security, Social Security, and Overtime Pay are not fully obtained by its workers, therefore the Company does not include these rights in its employment agreement, and the Obstacles that arise in the Implementation of the Employment Agreement between Outsourcing Workers and PT Rama Indonesia Pekanbaru are: Lack of employee understanding of their responsibilities, Workers are not disciplined, Worker abilities do not match work needs, Outsourcing Workers who do not carry out their obligations, and Uncertainty about the fulfillment of workers' rights.
