Abstract
ABSTRACT Default refers to the inability or negligence in fulfilling obligations as agreed upon in a contract between creditors and debtors. The genesis of credit issues typically stems from default, where debtors fail or are unable to fulfill promises stipulated in a car purchase agreement. This agreement entails a transaction where the seller transfers ownership of the car to the buyer upon payment of a certain amount, documented in a contract that delineates rights and responsibilities for both parties. This contract serves as the legal foundation binding the seller and the buyer. However, various challenges arise in its execution, including delivery delays, price and discount uncertainties, and complex administrative requirements. The focus of this research is to explore the legal implications arising from default in car purchase agreements with an indent system at the PT. Arista Auto Prima showroom in Pekanbaru. Additionally, this study aims to identify factors hindering the implementation of car purchase agreements with an indent system at PT. Arista Auto Prima in Pekanbaru. The research method employed is descriptive qualitative with an empirical legal approach, delving into how the law operates within the societal context, particularly concerning car purchase agreements with an indent system at PT. Arista Auto Prima in Pekanbaru. Primary data was obtained through interviews with management and staff at PT. Arista Auto Prima, as well as with buyers who experienced default in such agreements. The research findings indicate that legal consequences of default include consumers' rights to refunds or compensation, alongside potential fines or restitution payments to consumers. Hindering factors in car purchase agreements with an indent system encompass limited car stock, delivery delays, price and discount uncertainties, and administrative complexity. This research aims to provide deeper insights into the process of car purchase agreements with an indent system, and to offer recommendations for improving coordination among dealers, manufacturers, and distributors, enhancing transparency in price and discount determination, and simplifying purchase administration processes to enhance customer satisfaction.
