Abstract

Based on the results of the pre-survey research, the researchers found that the land certificate with Warkah Number: 8085/XII/RGT/1998 which has a land area of 10,000 M2 is located in Lahai Village, Seberida District, Indragiri Hulu Regency, Riau Province which is owned by Mr. M. Zen wants to do the process of transferring land rights through buying and selling but is hampered because the land is included in a production forest area. The formulation of the problem in this research is: What are the Roles and Responsibilities of Notaries and PPATs in the Process of Transferring Land Ownership Rights based on PP Number 24 of 1997 in Indragiri Hulu Regency. What are the obstacles and solutions faced by notaries and PPATs in the Indragiri Hulu Regency Working Area in the Process of Transferring Land Ownership Rights? This research adopts normative legal research methods. The results of this research are that the role and responsibility of PPAT in carrying out its duties, especially in the Indragiri Hulu Regency area, is to check every condition required in managing land rights. Whether it is related to the land being applied for or related to who handles the application for land rights. The checks carried out on the land are aimed at ensuring that there is no overlap on the land, while the checking of who is requesting the management must be clear because if there is a misunderstanding regarding the deed issued by the PPAT, the parties can be held responsible according to their respective roles regarding the applicable law. The obstacles faced by PPAT in carrying out its duties are: an irregular land administration system, limited number and expertise of surveyors at the land office. The exhumation process should be completed in a matter of days due to government bureaucracy. There was resistance from the community who submitted a request to make a Deed.
