Abstract

Technological developments influence cattle breeding efforts which are carried out using Artificial Insemination or what is called injection mating. Cattle breeding done naturally is rarely done by cattle breeders, breeders prefer to use Arificial Insemination because the process is fast and cost effective. However, there is a prohibition regarding artificial insemination in a hadith of the prophet Muhammad, which says that buying and selling animal semen is prohibited, because this buying and selling contains elements of gharar. The main problem in this research is how to implement the buying and selling of cow sperm through artificial insemination in Jayapura Village, Siak Sri Indrapura Regency and what is the perspective of Islamic law towards buying and selling cow sperm through artificial insemination in Jayapura Village, Siak Sri Indrapura Regency. The type of research used in this research is empirical legal research. The data collection technique used in this research was interviews with cattle breeders, artificial insemination officers, and religious leaders, as well as documentation related to the implementation of buying and selling cow sperm through artificial insemination from an Islamic legal perspective in Jayapura Village, Siak Sri Indrapura Regency. Based on the research result, it can be concluded that : buying and selling cow sperm in Jayapura Village, Siak Sri Indrapura Regency is carried out by officers selling cow sperm to breeders in the form of frozen semen in a straw, then the straw is stored in a tube. Islamic law views buying and selling cow sperm in Jayapura Village, Siak Sri Indrapura Regency as permissible because artificial insemination in these animals has meny benefits for society. And the animal sperm used has also been properly processed.
