Abstract

In life, livestock play an important role, especially in the economic sector, but if livestock are released without supervision from the animal owner and cause harm to other people, this can be classified as an unlawful act committed indirectly by a human individual as regulated in article 1368 of the Civil Code, In this case the author found a case of releasing wild livestock without supervision from the livestock owner and causing damage to PT. Perkebunan Nusantara II in Sei Litur Tasik Village, Sawit seberang Subdistrict, Langkat Regency, The main problem in this research is what the legal responsibility of livestock owners is for damage to PT. Perkebunan Nusantara II in Sei Litur Tasik Village, Sawit seberang Subdistrict, Langkat Regency, and what are the obstacles in implementing the legal responsibility of livestock owners for damage to PT. Perkebunan Nusantara II in Sei Litur Tasik Village, Sawit seberang Subdistrict, Langkat Regency, The research method that the author uses is empirical legal research by collecting data and information relating to the object to be researched by means of direct surveys in the field to collect primary data and secondary data obtained from respondents through interviews to be used as data or information as material for writing. this research, Based on the results of research on the legal responsibility of livestock owners for damage to PT. Perkebunan Nusantara II, livestock owners must look after and supervise their livestock, livestock owners are responsible for removing their livestock from the plantation area, livestock owners are required to pay a fine of 370,000 every head, then livestock confiscation, which in practice is still not heeded by livestock owners, then regarding obstacles in implementing the legal responsibility of livestock owners for damage to PT. Perkebunan Nusantara II is that the identity of the animal owner is not known for certain, then there is no good faith and legal awareness on the part of the livestock owner, then the livestock owner is not aware of the prohibition boards put up by the plantation owner, and the attitude is indifferent and indifferent by the livestock owner.
