Abstract

The smoking habit of minors is currently very worrying, especially in Simpang Baru Village, Bina Widya District, Pekanbaru City. In Government Regulation Number 109 of 2012 concerning Safeguarding of materials containing addictive substances in the form of tobacco products for health in Article 21 letter a there is a prohibition against selling cigarettes to children under 18 years of age. However, in reality traders continue to sell cigarettes to minors, this clearly proves that the existing regulations are still not working optimally, so protection is needed for consumers (children under 18 years of age) against actions carried out by business actors/traders. The formulation of the research problem is how to implement government regulation number 109 of 2012 concerning safeguarding materials containing addictive substances in the form of tobacco products for health in an effort to provide protection for minors in buying and selling cigarettes and how to limit the buying and selling of cigarettes to minors in society. (case study in Simpang Baru Village) In its implementation, Government Regulation Number 109 of 2012 to prevent the sale and purchase of cigarettes to underage children in Simpang Baru sub-district is still not optimal and can be said to be far from being realized. This is caused by many things, first seen from the traders' side, where based on the results of the author's interview, there are still many traders who do not know about the existence of these regulations and from the government's side, there is still minimal socialization carried out by the government to traders and also to children who are still young. under age..
