Abstract

Forest and land fires have always been a problem that always haunts the territory of Riau Province, precisely in Rokan Hilir Regency. Problems of criminal law enforcement against perpetrators of land and forest fires are confusing, this is because all prevention efforts and sanctions given do not also have a deterrent effect on the perpetrators and people who continue to clear land by burning. The formulation of the problem in this study is what are the factors that cause forest and land fires in the jurisdiction of the Rokan Hilir police, and how the police efforts in tackling forest and land fires in the jurisdiction of the Rokan Hilir police. This research was conducted using the empirical sociological legal research method, namely field research, which aims to collect primary and secondary data obtained from respondents. Data collection was done by in-depth interviews and observation. Informants in this study amounted to 6 people consisting of Head of Criminal Investigation Unit of Rokan Hilir Police, Head of Regional Disaster Management Agency, 1 Indigenous Leader and 3 convicted perpetrators of forest and land burning.. The results showed that forest and land fires are caused by many factors, including human negligence, deliberate land clearing, environmental factors. season and natural disasters such as lightning that strikes trees, but fires often occur due to human negligence. One of the cases studied was Dolok Marbu Silaban who burned forest and land initially with the intention of clearing land to make a pineapple plantation and was sentenced by the court to 3 years imprisonment. Efforts to overcome forest and land fires carried out by the Rokan Hilir Police are currently by providing posters on banners appealing to the public not to burn forests and land because it is protected by law and can be criminalized, as well as socialization to the community through babinsa and also patrols carried out when the dry season occurs. In addition, the Police conduct joint work with the TNI, BPBD, MPA, and other related agencies in forest fire prevention.
