Abstract

E-Commerce is a form of trade transaction that is most influenced by developments in information technology. Through this trade transaction, the traditional market concept where sellers and buyers physically meet has changed to the telemarketing concept, namely long-distance trading using the internet. ECommerce has also changed the way consumers obtain the products they want. Through E-Commerce, all formalities commonly used in conventional transactions are reduced, besides of course consumers also have the ability to collect and compare information such as goods and services more freely without territorial boundaries (borderless). Based on the background of the problem that the author described above, the author first determines what is the legal protection for Shopee consumers who suffer losses when buying and selling online in Bukit Raya District? And what are the obstacles in legal protection for Shopee consumers who are harmed by online buying and selling in Bukit Raya District? This writing, when viewed from the type of research, can be grouped into Sociological research conducted by survey, namely research directly to the research location using data collection tools in the form of interviews. Meanwhile, if viewed from its nature, this writing is descriptive, which means the research is intended to provide a detailed, clear and systematic description of the main research problems. Legal protection for Shopee consumers who suffer losses in online buying and selling in Bukit Raya District means that in reality the applicable laws cannot protect consumers as they should. The consumer rights contained in the consumer protection law, which is a form of legal protection for consumers from the government and the state, do not work as they should, so that many consumers experience losses caused by sellers, either due to default, unlawful acts, burglary fraud or other types of acts caused by business actors. The obstacles found from the results of research conducted by the author, cause legal protection for consumers to not be implemented or in fact legal regulations regarding consumer protection cannot protect consumers because of these obstacles. These obstacles include: Business actors who break their promises, business actors who do not have good intentions in complaints submitted by consumers, consumers who do not know the form of legal protection for themselves, taking a long time to submit returns/returns of goods in the Shopee application and finally because consumers who don't care so much that they don't ask for legal protection for themselves from business actors.
