Abstract

BTS (Base Transceiver Station) is a telecommunications infrastructure that facilitates wireless communication between communication devices and operator networks. Telecommunications development in Indonesia carries a broad mission. Telecommunications is a unifying tool for the nation and a driving force for economic growth and development as a whole. Problems begin to arise when the spatial balance and aesthetics of the surrounding area are the impact of the construction of telecommunication towers as a main supporting infrastructure in the operation of telecommunications which requires the availability of land, buildings and air space. The main problem of this research is how the legal protection for the construction of base transceiver stations (BTS) by PT. Dayamitra Telekomunikasi Tbk in Bukit Raya District, Pekanbaru According to Law No. 36 of 1999 concerning telecommunications?, and what are the obstacles in carrying out the construction of a base transceiver station (BTS) by PT. Dayamitra Telekomunikasi Tbk in Bukit Raya District, Pekanbaru??. The research method is a type of legal research, observational research or survey, namely research carried out directly to a predetermined research location to obtain information that supports the author's research. while its nature is descriptive, which describes the problem as clearly and as detailed as possible. The results of the study show that legal protection for the construction of base transceiver stations (BTS) by PT. Dayamitra Telekomunikasi Tbk in Bukit Raya Pekanbaru District According to Law No. 36 of 1999 concerning telecommunications, it has not been running optimally because the company has not carried out its full responsibility, especially when the existing equipment is lost and there is no replacement from the tenant, causing environmental effects, namely the high level of the temperature in the rental object which has an impact on the community environment and the unbalanced compensation and compensation funds provided to the community with the existence of a Base Transceiver Station (BTS), and Obstacles in Implementing the Development of a Base Transceiver Station (BTS) by PT. Dayamitra Telekomunikasi Tbk. In the Bukit Raya Pekanbaru District, there were difficulties in requesting permission to build BTS from some communities prior to the provision of compensation and compensation funds, there were objections to the establishment of BTS from the community because the community thought there would be a negative impact on the establishment of BTS such as high radiation which could damage the health of residents living near the BTS.
