Abstract

Marriage without a marriage certificate is a marriage carried out based on Islamic religious law without registering a marriage, this type of marriage is valid according to the Islamic religion if it fulfills the existing conditions and pillars of marriage, but according to Indonesian law, the marriage is invalid because it does not carry out marriage registration in accordance with what was ordered by the state contained in Law No. 1 of 1974 concerning marriage. The problems in this research are as follows: First, how can marriage without a marriage certificate be carried out in the village of Kenegerian Cengar. Second, what are the factors that influence the occurrence of marriages without a marriage certificate in the village of Kenegerian Cengar. The research method used is a type of sociological law. Where the author collects data and seeks information about the activities used as research objects. Meanwhile, the nature of this research is analytical descriptive, in which the author provides an overview of an object under study from the data and samples that have been collected by the author. The results of the research that the authors get are as follows: First, marriages without marriage certificates that are carried out in Kenegerian villages are carried out by referring to the pillars and conditions of marriage that are in accordance with the recommendations of the Islamic religion but the marriage is not registered with the relevant institution, namely the office of religious affairs. Second, the factors that influence marriage in the village of Kenegerian Cengar based on interviews conducted by the author with parties who carry out marriages without a marriage certificate are as follows: the factor of a divorce certificate that has not been issued. factor of not getting parental blessing, incomplete document factor, and polygamy factor.
