Abstract

Chairman of the Secretariat of the Financial Services Authority (OJK) Task Force for the Eradication of Illegal Financial Activities (Task Force Pasti) Hudiyanto said that the losses of the Indonesian people due to illegal investments (fraudulent investments) reached IDR 139.67 trillion from 2017 to 2023. An example in the case that happened to Indra Kenz as an affiliate of the binomo application, a fraudulent investment that did not have a license from the Commodity Futures Trading Supervisory Agency (Bappebti). The Investment Law has strictly regulated legal protection for investors who conduct transactions in the capital market. Despite the many cases of illegal investment (fraudulent investment) that still occur in Indonesia, the legal rule which is a form of legal certainty from the government towards investors is contained in Law No. 25 of 2007 concerning Investment which regulates the rights and obligations of investors. In the thesis entitled “Juridical Study of Legal Certainty for Online Trading Investors according to the Investment Law (Study on Indra Kenz's Online Trading Investment)” is discussed in the problem, namely: Legal Certainty for Online Trading Investors according to Law Number 25 of 2007 concerning Investment (Study on Indra Kenz's Online Trading Investment) and Legal Protection for Online Trading Investors according to the Indra Kenz Online Trading Investment Case. The results of the study show that legal certainty prioritizes certainty over the rights and obligations of citizens so as to create a sense of security for the community, which in this study is specifically for investors who are victims of Binary Option Affiliate Indra Kenz. In Decision Number 117PID. SUS/2022/PT BTN, related to legal certainty for investors who are victims of Binary Option Affiliates, namely by stipulating that Evidence Numbers 220 to 258 are returned to the Victim Witnesses through the United Indonesia Traders Association/Association. Regarding the case of Binary Option Affiliates by Indra Kenz, investors who are victims receive legal protection as they should, with the return of their property which was initially decided to enter the state treasury. It is known that the property belonging to the investors has nothing to do with gambling.
