Abstract

In fact, there are still many people or business actors, even most of the PERTAMINI business actors in the community today have not fulfilled the provisions of the Trading Business Permit (SIUP) which must be owned by everyone who owns a business. The main problem in this research is what is the impact of using the Pertamina logo which is used by business actors without permission from the brand rights holder? and What legal action can Pertamina take in dealing with the use of logs used by Pertamina? This type of sociological legal research can also be called field research, namely examining the applicable legal provisions and what is happening in reality in society. Based on the results of research on the use of the Pertamina logo by Pertamina traders without Pertamina's permission. Based on the Law of the Republic of Indonesia Number 20 of 2016 concerning Marks and Geographical Indications (Case Study on Jalan Kartama, Marpoyan Damai District, Pekanbaru City) it is known from the distribution of interviews and observations in the field that Pertamina's business is very profitable because of the fast profit turnover and the community is quite interested in buying fuel from traders who use Pertamina. Meanwhile, in terms of legal actions that can ensnare Pertamina's business actors, it is imprisonment for a period of several years and a large nominal fine in accordance with Law no. 22 of 2001 concerning Oil and Gas.
