Abstract

The implementation of development is inseparable from the role of planning construction services, which play an important role in supporting development activities in Indragiri Hilir Regency, which refers to the provisions of the Law. To carry out development, the Government needs a second party then the government conducts a selection in the form of auctions. After getting the winning bidder, the Government will make a Construction Work Contract. Law of the Republic of Indonesia Number 2 of 2017 Concerning Construction Services states that Construction Work Contracts are all contract documents governing the legal relationship between service users and service providers in the implementation of construction services. In this study, the authors define the main issues as follows How is the implementation of the chartering agreement between the Public Housing Agency and the Indragiri Hilir Regency Settlements with Cv. Rahmat Jaya, and How the legal consequences in the implementation of the contract of contract between the Public Housing Agency and the Indragiri Hilir Regency Settlement Area with Cv. Rahmat Jaya. The research method used was observational research by survey, the authors conducted research directly to the research location, namely the Office of Public Housing and Settlement Areas of Indragiri Hilir Regency and the Office of CV. Rahmat Jaya, to obtain the data needed by using data collection tools in the form of interviews and the nature of this study is descriptive which means this study provides an overview of a complete, detailed and clear statement about the implementation of the contract for construction of drainage channels. From the results of the study showed that in the implementation of the agreement there was a problem that the agreement did not work with what was agreed by the contractor did not carry out its obligations other than being late the contractor could not complete the work concluded because of negligence from the contractor aside from the absence of good faith. The legal consequences of the implementation of the contract for construction of a drainage channel in Indragiri Hilir Regency due to negligence of not being able to complete the work based on the results of the field research, a decision was made with a number of considerations, a unilateral termination of the contract was carried out by the Public Housing and Settlement Area of the Indragiri Hilir Regency.
