Abstract

The criminal acts committed by children in the jurisdiction of the Rokan Hilir Police which the author studied were criminal acts of motor vehicle theft by damaging parked motorized vehicles and even seizing them from the hands of their owners by threatening and even injuring the victim. This action was carried out by the child and his partner. The perpetrators took action at night and in groups similar to the perpetrators of thugs. Apart from seizing the victim's vehicle, the child perpetrators also took the victim's valuables. Based on the above background, the main problem in writing this thesis is firstly, the law at the level of investigation against children as perpetrators of the crime of theft with objections in the legal area of the Rokan Hilir Police and law enforcement at the level of investigations against children as perpetrators of the crime of theft with sanctions in Rokan Hilir Police Legal Area. This type of research is a sociological or observational research by survey, which is a study that takes data directly from the population with a data collection tool that is an interview, after which the data is taken and processed to obtain conclusions with the deductive method. Meanwhile, if seen from its nature, then this research is descriptive in nature, research that explains in clear and detailed sentence form. Law enforcement at the level of investigation against children as perpetrators of the crime of theft by weighting in the legal area of the Rokan Hilir Police is carried out through a restorative justice mechanism with efforts to diversify children as perpetrators of criminal acts of theft with weightings as mandated in Law No. 11 of 2012 concerning the Juvenile Criminal Justice System and of the 23 cases that occurred over the past 3 years, there are at least 17 cases of criminal theft with weighting that can be attempted to be diversified by the Rokan Hilir Police, while the other 6 (six) cases cannot resolved by diversion, but through the stages of trial in juvenile court. Barriers to Law Enforcement at the level of investigation against Children as Perpetrators of Crime of Theft with Objection in the Legal Area of the Rokan Hilir Police include the legal factors themselves, law enforcement factors, namely the parties who form or implement law, facilities or facilities that support law enforcement. , community factors, namely the environment in which the law applies or stipulated and cultural factors, namely as a result of work, creativity and taste based on human initiative in social life.
