Abstract

The regulation regarding pirates in UNCLOS III is regulated in the convention on the high sea, especially in articles 100 - 107 of the Convention. Where in its implementation it takes a National Law from each country to regulate detailed matters in implementing the articles of this convention. In this research, the problem formulation is what is the authority to arrest and prosecute pirates according to the UNCLOS 1982 maritime law convention and how are Indonesia's rights and obligations in facing pirate crimes in its jurisdiction. The research method used in this study is a normative juridical approach, which is an approach that performs legal analysis of statutory regulations related to the title of the thesis. The data used are primary, secondary, and tertiary legal materials. The data collection method in this thesis uses the library research method, namely by conducting research from various reading sources such as books, magazines, scholars' opinions, websites and also other lecture materials. The results of the discussion show that the regulation regarding piracy in the jurisdiction of Indonesia in order to suppress the development of pirates is contained in Law No. 17 of 1985 concerning Ratification of the United Nations Convention on the Law of the Sea, Law No. 32 of 2014 concerning Maritime Affairs, and the Criminal Code. Other related regulations are regarding the Indonesian Archipelago Sea Route (ALKI) and the Right of Peaceful Passage. As for the punishment of pirates based on the national laws of each country.
